Rodriguez was apprehended for assault in 2002 after she got in a fight with her roommate. The charges were dropped when her roommate refused to press charges. Rodriguez went to court in 2003 to face eight misdemeanor charges because of two driving incidents, which included DUI (driving under the influence) and a hit and run. She pleaded no defense in June 2004 to three charges in Los Angeles including driving with a suspended license, drunken driving, and Hit and run. She was put on probation for three years, finished a three-month alcohol program went to jail for 48 hours, and performed community service in two New York hospital morgues.

While filming Lost in Hawaii in 2005, she was pulled over several times for speeding violation by Honolulu police, and on 1st December, she was arrested for DUI. In April 2006, she spent five days in jail and paid a US$500 fine when she pleaded guilty to a DUI charge.

Rodriguez quoted her high doses of allergy-relieving steroids as one of the reasons for her unstable behavior. She violated Los Angeles probation with the incident and as a result, she was sentenced to 6o days in jail, an alcohol rehabilitation program for 30 days, and community service for 30 days, this includes working for Mothers Against Drunk Driving. She was released from jail on the same day she entered because of overcrowding.

Rodriguez did not complete her community service or alcohol education program thus violating her probation in September 2007. She agreed to violate the probation on 10th October 2007 and was sentenced to 180 days in jail. Rodriguez was however released 18 days later because of overcrowding. She finished her community service in January 2009.
